New Hampshire does not tax capital gains, and — a nuance worth recording — NEVER DID, even before the Interest and Dividends Tax was repealed. RSA chapter 77 reached interest and dividends only. The Department's own administrative rules made the carve-out explicit: Rev 902.05(d) listed among amounts NOT taxable as dividends 'Capital gains realized by the investor through the sale of his or her interest in a mutual fund', and Rev 901.09 defined a dividend as a distribution from current or accumulated profits 'other than in liquidation', which definitionally excludes gain on the sale of a capital asset. The old DP-10 even carried a deduction reason code for backing out capital gains a payer had reported as dividends. Anyone describing pre-2025 New Hampshire as taxing 'investment income' generally is overstating it.
